1. Acceptance of Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the website, mobile application, online store and related services collectively referred to as "Digital Platforms", operated by Diplomat's Dog (Pty) Ltd ("we", "us", or "our").

By accessing or using our Digital Platforms, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use our Digital Platforms.

2. Services Provided

Through its Digital Platforms, we provide personalized dog food for purchase on a subscription basis, along with tools to manage and adjust your dog's nutritional intake over time. These adjustments are informed by changes in your dog's lifestyle and nutritional profile. Product formulations and recommendations may change over time based on nutritional research and product availability. We may update, modify or discontinue part of the services at any time with or without notice.

3. Eligibility

To use the Digital Platforms, you must:

• Be at least 18 years old (or be under the supervision and with the consent of a parent or legal guardian if under 18).

• Have the full legal right and capacity to enter into a binding agreement with another party under South African law.

4. Account Registration

You may need to create an account to access certain features. This may include setting up a username (email) and password, amongst other personal details, such as delivery address/es.

You agree to:

• Provide accurate and complete information.

• Keep your login credentials confidential. It is your responsibility not to disclose this information to a third party.

• Accept responsibility for all activities under your account.

We may suspend or terminate accounts that violate these terms or applicable laws.

Should you believe your information to be compromised, please contact us immediately.

By creating an account, you agree to receive essential service communications (such as order updates, account notifications, and delivery information).

You may choose to opt in or out of marketing communications at any time via your account settings or by using the unsubscribe link provided in marketing emails.

5. Fees and Payments

Payments for paid services or subscriptions are processed through Peach Payments (Pty) Ltd, our secure third-party payment provider.

By completing a transaction, you agree to Peach Payments' Privacy Policy and terms of service.

We do not store or have access to your full payment details; only transaction references are kept for record-keeping.

All prices include applicable South African value added taxes (VAT) unless otherwise stated.

Currency: All prices and transactions are in South African Rand (ZAR).

6. Session Management and Authentication

We use JSON Web Tokens (JWTs) and refresh tokens to maintain your authenticated session. Refresh tokens may be stored in secure cookies or secure device storage depending on your platform. You are responsible for keeping your login credentials confidential.

7. Acceptable Use

You agree not to:

• Do not use the Digital Platforms for unlawful, fraudulent, or harmful activities.

• Do not interfere with, damage, or disrupt the Digital Platforms or servers.

• Do not attempt to gain unauthorized access to accounts, data, or systems.

• Do not upload or distribute abusive, threatening, discriminatory, defamatory, pornographic, or otherwise offensive content.

• Do not send spam, junk mail, or unsolicited communications.

• Do not expose or attempt to expose another user's personal information.

• Do not reverse engineer, copy, or distribute our code or IP without written permission.

Violation of this clause may lead to immediate suspension/termination of services and/or legal action.

8. Intellectual Property

All intellectual property rights in the Digital Platforms, including trademarks, logos, software, design, and content, belong to Diplomat's Dog (Pty) Ltd or our licensors.

You agree that you will not in any way, with or without the aid of tools and/or software, monitor, copy, reproduce, distribute or modify the digital services or the information contained within, without prior written consent from Diplomat's Dog (Pty) Ltd.

You may not in any way display, publish, copy, print, post or otherwise use the Digital Platforms and/or the information contained therein without the express prior written consent from Diplomat's Dog (Pty) Ltd.

9. Health & Nutrition Disclaimer

Information, recommendations, and nutritional guidance provided on our digital platforms are general in nature and are not a substitute for professional veterinary advice. Always consult a qualified veterinary practitioner regarding any specific concerns about your dog's health, diet, or medical conditions.

Diplomat's Dog (Pty) Ltd is not responsible for adverse outcomes arising from reliance on general guidance provided through the digital platforms.

10. Links to External Websites

Diplomat's Dog (Pty) Ltd's Digital Platforms may contain links or references to other websites/resources which are outside of our control. These Terms and Conditions do not apply to those Third-Party Websites and we are not responsible for the practices and/or privacy policies of those Third-Party Websites or the "cookies" that those sites may use.

11. Third-Party Services

Our Digital Platforms integrate with third-party providers, including:

• Peach Payments for transaction processing.

• Google Maps Platform APIs for maps and location features to ensure accurate delivery addresses.

• Cartrack for delivery routing and tracking.

• Microsoft Azure for cloud hosting.

Each third-party service is governed by its own terms and privacy policy. We are not responsible for the content, security, availability, or privacy practices of third-party websites.

12. User Content

If you upload or submit content (such as messages, photos, or comments), you:

• Grant us a non-exclusive, worldwide, royalty-free license to display and distribute that content within the Digital Platforms.

• Represent that you own or have the right to share such content.

We reserve the right to remove content that violates these Terms or applicable law.

13. Privacy and Data Protection

Your personal information is handled in accordance with our Privacy Policy, which complies with the Protection of Personal Information Act (POPIA) and GDPR standards.

By using our Digital Platforms, you consent to the processing of your information as described in that policy.

14. Limitation of Liability

To the maximum extent permitted by law, Diplomat's Dog (Pty) Ltd and its directors, employees, or affiliates will not be liable for:

• Any indirect, incidental, or consequential losses, damages or expenses incurred,

• Loss of data, revenue, or goodwill,

• Errors or downtime caused by third-party providers,

arising from your use or inability to use the Digital Platforms and the products and contents supplied, listed or referred to on the Digital Platforms.

Furthermore, information, ideas and opinions expressed on the Digital Platforms should not be considered as professional advice. Should you be in doubt or concerned about your dog's health, consult a veterinary practitioner.

You further agree that Diplomat's Dog (Pty) Ltd will not be liable if it chooses to suspend, modify or terminate this website and accompanying digital services, other than for processing any order made prior to the termination, to the extent possible.

Nothing in these Terms excludes or limits our liability for gross negligence, wilful misconduct, or any liability that cannot be excluded under South African law.

15. Disclaimer

We provide the Digital Platforms "as is". We do not give any express or implied warranty or make any other promise about the Digital Platforms. We do not warrant that it is good quality, fit for any particular purpose, accurate, complete, up-to-date, reliable, legally effective or secure. We also do not warrant that it is free of latent defects, errors, malicious software or infringing content, or that you will have quiet or uninterrupted use of it.

You use our Digital Platforms at your own risk and we make no warranties about it.

16. Termination

We may suspend or terminate your account or access to the Services if:

• You violate these Terms or applicable laws;

• We are required to do so by law; or

• The Services are discontinued.

You may stop using the Services at any time. Termination does not affect accrued rights or obligations.

17. Force Majeure

We are not liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from events beyond our reasonable control. These include, but are not limited to, supply chain disruptions, ingredient shortages, manufacturing delays, natural disasters, power failures, internet outages, pandemic events, or transportation and logistics interruptions.

18. Governing Law and Jurisdiction

These Terms are governed by South African law and the Consumer Protection Act, 68, of 2008.

19. Changes to These Terms and Conditions

Diplomat's Dog (Pty) Ltd reserves the right to change these terms and conditions periodically. When such updates are made, the "Last Updated" date will be amended, and a notification will be provided to registered users via the app. New terms and conditions replace and supersede previous terms and conditions. Your continued use of the Digital Platforms after changes are published constitutes your acceptance of the revised terms and conditions.
